Biku Furniture & Homewares Dream Home Makeover Giveaway Terms and Conditions

These Terms and Conditions apply to the Biku Furniture & Homewares Biku Dream Home Makeover Giveaway (the “Campaign”). By participating, all entrants agree to be bound by these terms.

By checking the box to accept these Terms and Conditions and signing up for Biku Dream Home Makeover Giveaway, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions in their entirety. This agreement shall serve as the sole terms governing your participation in Biku Dream Home Makeover Giveaway.

By clicking the checkbox to accept these Terms and Conditions, you consent to use an electronic signature to demonstrate your agreement. You agree that your electronic consent serves as the legal equivalent of a handwritten signature.

By agreeing to these Terms and Conditions, you confirm that you fully understand and accept all conditions set forth in this document and have had the opportunity to ask questions or seek clarification if needed.

  1. Campaign Details
  • Promotion Period:
    • Start Date: November 15, 2024
    • End Date: March 31, 2025, or until 30 eligible participants have signed up, whichever is later. The Promotion Period may extend beyond March 31, 2025, if fewer than 30 participants have signed up by that date, with the Campaign remaining open until the target is met.
    • Final Draw Date: April 30, 2025, or four weeks after the final participant signs up if the target of 30 participants is not reached by March 31, 2025.
  • Participant Target: Biku Dream Home Makeover Giveaway aims to reach 30 eligible participants. If 30 participants have not signed up by March 31, 2025, Biku Dream Home Makeover Giveaway will remain open until this target is met.
  1. Definitions
  • Eligible Purchase: Purchases directly associated with the property detailed in the participant’s service agreement and made from Biku Furniture & Homewares or approved wholesalers during the Promotion Period. Purchases from unrelated third-party retailers or those involving trade discounts do not qualify as eligible purchases.
  • Participant: An individual who meets all eligibility and entry requirements as defined in these Terms and Conditions.
  • Personal Shopping Service: A free interior decorating service where Biku creates a 3D plan and concept board based on the participant's style and budget. The participant may purchase items from Biku’s showroom or wholesalers.
  • Paid Interior Decorating Service: A premium, fee-based service including assistance with material and finishing selections, purchasing from retailers, and more comprehensive project support.
  1. Eligibility
  • This Campaign is open to all customers who complete a qualifying purchase through either the Personal Shopping Service (also known as the Free Interior Decorating Service) or the Paid Interior Decorating Service during the Promotion Period.
  • This promotion is only available to new sign-ups. Customers who are already engaged in a purchase process or in progress with the Personal Shopping or Interior Decorating Service prior to the Promotion Period are not eligible to participate in the Campaign.
  • Only purchases made after signing up for the Personal Shopping or Paid Interior Decorating Service are eligible for the 100% refund draw.
  • Only Biku Furniture & Homewares employees and their immediate family members (defined as spouses, children, siblings, and parents) are ineligible for this Campaign.
  • Minimum Spend Requirement: A minimum spend of $7,500 within the Promotion Period is required to qualify as a Personal Shopping or Interior Decorating Service client. Purchases below this amount will be classified as retail purchases and are not eligible for this Campaign.
  • Purchases may be made in-store or online, and multiple invoices during the Promotion Period will count toward the refund as long as they are made before the final participant signs up and comply with all eligibility requirements.
  • To qualify for milestone rewards, participants must meet all criteria outlined in the Milestone Rewards section of these Terms and Conditions, including completing their associated service and payment obligations.
  1. How to Enter
  • Entry into Biku Dream Home Makeover Giveaway is automatic upon completing a qualifying purchase through either the Personal Shopping Service or the Paid Interior Decorating Service within the Promotion Period.
  • Only one entry is permitted per participant based on their sign-up for the Personal Shopping or Paid Interior Decorating Service.
  • Purchases must be for the property detailed in the participant’s service agreement. Purchases for properties not included in the service plan or for third parties (e.g., family or friends) are not eligible.
  1. Promotion Structure and Prize
  2. Guaranteed 100% Refund Draw
  • One participant will be awarded a full refund of the total amount spent on eligible purchases during the Promotion Period.
  • Eligible purchases include all valid transactions made directly with Biku or its wholesalers, covering both furniture and interior decorating costs, excluding any clearance items from the retail store.
  • The winner will be selected through a randomized draw conducted in-store by Biku Furniture & Homewares. All participants will be invited to attend the draw, but attendance is not required to win. If a participant is unable to attend, the prize will still be honoured.
  • Finality of Draw Outcome: The draw results are final, and Biku Furniture & Homewares will not entertain any correspondence or disputes regarding the outcome.
  1. Milestone Rewards

The Campaign includes milestone rewards for participants based on the order in which they sign up during the Promotion Period.

  • Participants are eligible for milestone rewards if they:
    • Complete the Personal Shopping Service or Paid Interior Decorating Service associated with their sign-up.
    • Fully pay for all qualifying purchases required for their service before the Promotion Period ends.
  • Eligibility for milestone rewards is subject to verification by Biku Furniture & Homewares. Participants who fail to meet all qualifying criteria, including completing the service and payment, will forfeit their claim to milestone rewards.
  • Biku Furniture & Homewares reserves the right to substitute milestone rewards with items of equal or greater value if necessary.
  • Milestone rewards are non-transferable and cannot be redeemed for cash or other substitutions unless otherwise specified.
  • Participants must fully pay for all qualifying purchases before the end of the Promotion Period to claim milestone rewards.

 

  1. Draw and Winner Notification
  • Draw Date and Location: The draw will occur in-store on April 30, 2025, at 54 Bundall Road, Bundall, QLD (or 30 days after the 30th participant completes their service and payment obligations if the participant cap of 30 is not reached by March 31, 2025). The winner will be selected through a randomized automated electronic draw.
  • Notification Process: Participants will be invited to attend the draw in-store, but attendance is not required to win. If the winner is present, they will be notified in person during the event. If the winner is not in attendance, they will be notified via phone and email immediately following the draw. The draw will also be streamed live on Biku’s social media channels, and the winner will be announced on the Biku website and social media platforms.
  • Unclaimed Prize: The prize must be claimed within 30 days of the initial notification. If the prize is not claimed within this timeframe, a redraw will be conducted using the same randomized automated electronic draw process. The redraw will also occur in-store at 54 Bundall Road, Bundall, QLD, and the winner will be notified via phone and email immediately following the redraw.
    • Participants will be notified via email and social media about the redraw process, including the redraw date and location.
    • Winners must respond to notification emails or phone calls confirming their claim within 30 days.
  1. Terms for Prize Redemption
  • Refund of the purchase price (for the 100% Refund Draw winner) will be processed via bank transfer within 30 days of winner confirmation, upon receipt of the winner’s bank account details.
  • The prize is non-transferable and non-exchangeable. Biku Furniture & Homewares reserves the right to substitute any reward with a similar item if necessary.
  1. Disqualification
  • Biku Furniture & Homewares reserves the right to disqualify any participant found to be attempting to manipulate or undermine the integrity of Biku Dream Home Makeover Giveaway. This includes but is not limited to:
    • Providing false or misleading information.
    • Making purchases for properties not covered by the service plan.
    • Making purchases for third parties not included in the service plan and concept board.
    • Failing to proceed with item selections after signing up for the Personal Shopping or Interior Decorating Service, thereby not qualifying as an active participant.
    • Not meeting the minimum spend requirement within the Promotion Period.
    • Failing to meet the requirements for milestone rewards, including completion of the associated service and full payment for qualifying purchases within the Promotion Period.
  1. Participant Responsibility for Information Accuracy
  • It is the responsibility of each participant to provide accurate contact and bank details. Biku Furniture & Homewares will not be liable for delays or issues in processing the refund due to incorrect information provided by the participant.
  1. Dispute Resolution
  • In the event of any dispute or ambiguity regarding these Terms and Conditions or any aspect of Biku Dream Home Makeover Giveaway, Biku Furniture & Homewares reserves the right to interpret and apply these terms as it deems fair and appropriate. Biku’s decisions are final and binding. These Terms and Conditions do not limit your rights under Australian Consumer Law, and any dispute resolution or limit of liability clauses are subject to these statutory rights.
  1. Modification of Promotion
  • Biku Furniture & Homewares reserves the right to cancel, alter, or suspend Biku Dream Home Makeover Giveaway at any time due to unforeseen circumstances that affect Biku Dream Home Makeover Giveaway’s fairness or integrity.
  • Biku Furniture & Homewares reserves the right to update these Terms and Conditions at any time to reflect changes in our promotional policy or as required by law. Any updates will be posted on the landing page, and participants who have already signed up will be notified via email.
  • Any changes to Biku Dream Home Makeover Giveaway will be communicated to participants via email and posted on Biku’s website and social media channels.
  • Biku Furniture & Homewares reserves the right to adjust milestone rewards during the Campaign. Any updates to rewards will be communicated to participants via email and posted on Biku’s website.
  1. Compliance with ACCC and Fair Trading Laws
  • This Campaign complies with the Australian Consumer Law and Fair Trading Act, including fair play, transparency, and consumer protection standards.
  1. Privacy and Consent
  • By participating in this Campaign, participants consent to the collection, use, and disclosure of their personal information by Biku Furniture & Homewares for the purposes of administering Biku Dream Home Makeover Giveaway and awarding prizes.
  • Participants also consent to the publication of their name and image on Biku’s social media platforms if selected as the winner.
  • Biku Furniture & Homewares will handle all personal information in accordance with the Privacy Act 1988 (Cth).
  1. Publicity and Marketing Consent
  • By participating in Biku Dream Home Makeover Giveaway, participants agree that Biku Furniture & Homewares may use their name, image, and likeness in promotional materials, social media posts, or other marketing communications related to Biku Dream Home Makeover Giveaway without additional compensation.
  1. Audit and Verification
  • Biku Furniture & Homewares reserves the right to verify each participant’s eligibility, including purchase records and service details, to ensure compliance with these Terms and Conditions. Verification may include requests for documentation or records to confirm eligibility, conducted fairly and in compliance with these terms.
  • Biku Furniture & Homewares reserves the right to decline any purchases deemed ineligible under these terms, even if they meet the minimum spend but do not comply fully with the service agreement.
  1. Final Sale and Warranty
  • Final Purchase Requirement: All purchases made to qualify for Biku Dream Home Makeover Giveaway are considered final and cannot be returned or exchanged, except as required by law. Items purchased as part of this Campaign are not eligible for return unless they are faulty or not as described under Australian Consumer Law. In the event the prize is awarded as a 100% refund, items already refunded under ACL consumer guarantees will not be included in the total.
  • Warranty and Consumer Guarantees: Biku Furniture & Homewares will honor all applicable consumer guarantees under Australian Consumer Law. However, for the winner of the 100% refund, warranty obligations for refunded items will end, as the original purchase transaction will be effectively voided through the full refund. For all other participants, standard warranty conditions apply as per Australian Consumer Law.
  1. Limit of Liability
  • Biku Furniture & Homewares will not be liable for any indirect, incidental, or consequential damages, or any loss or damage arising from participation in Biku Dream Home Makeover Giveaway, the draw, or any claims regarding the refund beyond the applicable consumer guarantees under Australian Consumer Law.
  1. Force Majeure
  • Biku Furniture & Homewares shall not be liable for any failure to perform, or delay in performing, any of its obligations under these Terms and Conditions if such failure or delay is caused by events beyond its reasonable control, including but not limited to natural disasters, acts of government, war, civil unrest, strikes, or any other force majeure event. In the event of such occurrences, Biku Furniture & Homewares reserves the right to suspend, modify, or cancel Biku Dream Home Makeover Giveaway as necessary, with notice provided to participants via Biku’s website and social media channels.
  1. Governing Law and Jurisdiction
  • These Terms and Conditions are governed by the laws of Queensland, Australia. By participating in Biku Dream Home Makeover Giveaway, participants submit to the exclusive jurisdiction of the courts of Queensland for any disputes arising out of or in connection with Biku Dream Home Makeover Giveaway.
  1. No Waiver of Rights
  • Failure by Biku Furniture & Homewares to enforce any part of these Terms and Conditions shall not constitute a waiver of those rights. Biku reserves the right to enforce its rights at any time.
  1. Severability
  • If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
  1. Miscellaneous
  • Biku Furniture & Homewares reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on Biku’s website and social media channels.

    24. Entire Agreement

  • These Terms and Conditions constitute the entire agreement between Biku Furniture & Homewares and participants regarding Biku Dream Home Makeover Giveaway. Any prior communications or understandings are replaced by these Terms and Conditions.
